🏴☠️ Brews Cruise Liability Waiver & Release of Claims
By purchasing a ticket to Brews Cruise hosted by The Modern Day Pirates, I acknowledge and agree to the following:
1. Assumption of Risk
I understand that participation in this event involves inherent risks, including but not limited to:
Boat transportation
Dock and marina conditions
Uneven terrain on the island
Slips, falls, weather conditions
Alcohol consumption by myself or others
Physical activity related to games or scavenger hunts
I voluntarily assume all risks associated with attendance and participation.
2. Release of Liability
I hereby release, waive, and discharge: The Modern Day Pirates, its owners, crew members, volunteers, affiliates, vendors, boat operators, and partners
from any and all claims, liabilities, damages, injuries, losses, or expenses arising out of or related to my participation in this event.
This includes claims arising from negligence to the fullest extent permitted by law.
3. Alcohol Responsibility
I confirm:
I am 21 years of age or older.
I will drink responsibly.
I understand I am solely responsible for my actions while under the influence.
The event organizers are not responsible for any injury, damage, or incident resulting from my intoxication.
4. Medical Treatment
I consent to receive emergency medical treatment if deemed necessary and understand that I am financially responsible for any such treatment.
5. Weather & Event Changes
I understand this is a rain-or-shine event unless conditions are deemed unsafe by the organizers or boat operators. Schedule adjustments may occur.
No refunds unless the event is officially canceled.
6. Photo & Video Release
I grant permission for The Modern Day Pirates to use photographs or videos taken during the event for promotional purposes without compensation.
7. Participant understands that departure from the mainland and return departure from Kelleys Island occur at scheduled times and cannot be delayed. Participant assumes full responsibility for arriving on time for both initial boarding and return reboarding. If Participant fails to board at any scheduled departure time, they assume all responsibility for securing alternate transportation and any related costs. Event organizers, vessel operators, sponsors, and affiliates assume no liability for missed departures.
8. Agreement & Digital Acceptance
By completing this ticket purchase, I acknowledge that:

I understand its contents.
I voluntarily agree to its terms.
This digital agreement serves as my legally binding signature.
